Terms & Conditions

1. The apartment is let to the Hirer for an agreed term for the exclusive use as a holiday apartment and for no other purpose. Any agreement entered into between the parties shall not operate under any circumstances to create a tenancy either at common law or under statute and the Hirer agrees to surrender possession of the apartment at the conclusion of the agreed term.

2. All periods of hire shall commence at 4pm on the day of arrival and shall finish at 10am on the day of departure, unless agreed otherwise. Please contact us to arrange alternative arrangements at least 7 days before the start of the agreed term.

3. The person making the booking agrees to be bound by them and acknowledges that they form the basis of the contract between the parties. Such person also acknowledges that a copy of these terms and conditions will be shown to all other people staying in the apartment and unless such persons express a contrary view in writing, all other occupants agree to be bound by these terms and conditions. In the event of damage caused by a member of the party being unrecoverable from that party the person signing these terms and conditions agrees to indemnify the Owner for such loss and damage.

4. The Hirer does not have any authority to sub-let or in any way use the apartment other than as a holiday let for themselves and members of their party. The Hirer will when acknowledging these terms supply the full name and address of all people staying in the apartment during the agreed term.

5. The Hirer undertakes to take all reasonable care in the use of the property and its contents, including the security of the property. The Hirer will report any damage, losses or breakages as soon as they occur. The Owner reserves the right to charge for repairs, losses or replacements necessitated by the negligent act or omission of any of the Hirer's party, guests or invitees. If necessary, this may include an administration charge.

6. The Hirer and their party undertake to conduct themselves at all times in an appropriate manner and will respect the privacy and needs of the neighbours.

7. Upon departure the Hirer will ensure that the property is left in a clean and tidy state, and that all doors and windows are securely locked. The Owner reserves the right to charge for additional cleaning when necessary.

8. The property is accurately described insofar as practicable. All facilities are located on the ground floor. The front of the property has 3 steps which are wide and relatively shallow and are easily navigated by wheelchair users. Alternative arrangements can be made for those with severely restricted mobility, but 3 weeks notice is required prior to the start of the agreed term.

9. A non- refundable deposit of 50% of the full price of the holiday is required at the time of booking. Payment of the balance must be paid in full 3 weeks prior to the start of the agreed letting term. All cheques must be made payable to Simon Chiverton and sent to Green Birches, Chase Lane, Swynnerton Nr Stone Staffordshire. ST15 0RG. For late bookings, payment in full must be sent at time of booking and in any event not less than 7 days prior to the start of the agreed letting term.

10. Keys will be available for collection on arrival from a key safe accessed by combination code and must be left in the safe on departure.

11. In the event that the Hirer wishes to cancel a booking at least 6 weeks notice must be given in writing to the Owner in order to obtain a refund. If notice of cancellation is received at least 6 weeks before commencement of the letting term the Owner will refund any sums paid excluding the deposit. In the event that the Owner is forced to cancel the letting term a full refund will be given and/or alternative dates offered. The Owner will not be liable for any additional losses incurred as a result of such cancellation. YOU ARE STRONGLY ADVISED TO PURCHASE HOLIDAY INSURANCE THAT WILL COVER ANY LOSSES INCURRED BY CANCELLATION.

12. Sefton Court is a strictly no smoking property and smoking is not allowed anywhere in the apartment or communal areas.

13. Pets are only allowed by prior agreement with the owner. Please contact us to discuss if necessary. This exclusion does not apply to guide dogs accompanying the blind or partially sited or dogs trained to assist the deaf or hearing impaired.

14. It is a condition of insurance that the property is fully secured when left unattended. Please check with your household insurer regarding cover for personal belongings. You are advised not to leave valuable items in the apartment or your vehicle whilst parked at the property and no liability is accepted by the Owner for loss or damage of personal items.
